New York Secure Choice Savings Program

The NY Secure Choice Savings Program is a new state-mandated retirement initiative launching in late 2025 or early 2026. Employers with 10+ employees who don’t currently offer a qualified retirement plan will be required to automatically enroll staff in this program. New York Secure Choice: Mandatory State Retirement Program for Private-Sector Employers Begins in 2026

Beginning March 2026, most private-sector employers in New York State will be required to participate in the New York Secure Choice Savings Program, a state-sponsored retirement initiative for employees who do not have access to a workplace retirement plan. Eligible businesses with 10 or more employees that have been operating for at least two years must either register for the program or certify their exemption by state-mandated deadlines based on company size. The program automatically enrolls employees at a default contribution rate of 3% of gross pay into a Roth IRA, while allowing them the option to opt out. As part of a growing national movement to expand retirement access, employers must ensure compliance with registration and payroll deduction requirements to avoid penalties.
